Professor Ware Writes
the
Book on Alternative Dispute Resolution
"lternative
Dispute Resolution [ADR] is still a fairly new term in the legal
field. While lawyers did not talk about ADR before the 1970s, they
have long engaged in the practice, which encompasses alternatives
to litigation such as negotiation, mediation and arbitration.
Only recently has ADR emerged as a distinct field of study in law
school. As a result, literature on the subject is growing. Much
of what has been written, however, is prescriptive guidance for
practitioners, containing suggestions on how to be a better mediator,
etc. Other writings on the subject run the gamut from descriptive
to theoretical to philosophical.
Now, Professor Stephen J. Ware of Samford's Cumberland School of
Law has written a book on the law of ADR. The book, Alternative
Dispute Resolution, was published this spring by West Group, the
nation’s leading publisher for the law school market, as part of
its Hornbook Series.
"This
is a law book, written by a lawyer, for lawyers and law students,"
Ware assures readers in his preface. "There is a body of legal
doctrine-from statutes, judicial decisions and other sources-focused
on ADR. This doctrine is prominent throughout this book."
Ware, a noted ADR scholar, holds the B.A. degree from the University
of Pennsylvania and the J.D. degree from the University of Chicago.
He has been a member of the Cumberland faculty since 1993.
